OFFICIAL RULES
ENTRY PERIOD 3/1/06 – 5/31/06. ALL ENTRIES MUST BE RECEIVED BY 6/14/06.
1. HOW TO ENTER: You will automatically receive one (1) entry into the TopChoice Distributor Incentive Sweepstakes (“Sweepstakes”) each time you sell 200 pounds of TopChoice insecticide between 3/1/06 and 5/31/06 (“Entry Period”) and mail a completed invoice or distributor print-out of records that meet Sponsor’s specifications, hand-printed with your name, address, city, state, zip code, phone number (with area code) and licensed distributor name to: TopChoice Distributor Incentive Sweepstakes, PO Box 1166, Grand Rapids, MN 55745-1166. Product must be purchased as one (1) transaction. To enter without a purchase, hand-print with your name, address, city, state, zip code, phone number (with area code) and licensed distributor name on a 3" X 5" piece of paper, and send to: TopChoice Distributor Incentive Sweepstakes PO Box 1166, Grand Rapids, MN 55745-1166. ALL ENTRIES MUST BE RECEIVED BY 6/14/06. No illegible, incomplete, forged, altered or mechanically reproduced entries will be accepted. Enter as often as you wish, however, each entry must be mailed separately. All entries become the exclusive property of Bayer Environmental Science (“Sponsor”) and will not be returned.
2. SELECTION OF WINNERS: Potential winners will be determined from all eligible entries received in a random drawing to be conducted on or about 6/21/06 by an independent judging organization, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning depend upon the number of eligible entries received. Potential winners will be notified by phone or overnight mail.
3. PRIZES: One (1) Grand Prize: An 8 day/7 night trip for two (2) to Barbados. Trip includes: round trip coach air transportation for two (2) from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor), double occupancy standard hotel accommodations (one (1) room), and round trip ground airport/hotel transfers. Grand Prize travel must be completed by 5/31/07 or prize may be forfeited and Sponsor will have no further obligation to winner. Approximate retail value (“ARV”): $6,300. One (1) First Prize: 3 day/2 night trip for four (4) to a NASCAR® Nextel Cup Race of winner’s choice approved by Sponsor. Trip includes: round trip coach air transportation for four (4) from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor); quadruple occupancy standard hotel accommodations (one (1) room); a 2-day mid-size car rental, and four (4) tickets to the NASCARâ Nextel Cup Race (the “Race”) (subject to availability; seating to be selected by Sponsor). Car rental subject to winner and/or guest holding a valid U.S. driver’s license and qualifying as an eligible driver under applicable car rental company policy (including the attainment of age 25) and other rental car company terms and conditions. Car rental does not include gas, tolls, parking fees, collision waiver insurance, or any other related fees and is subject to car rental company terms and conditions. Winner and guest must comply with all applicable track rules and regulations. Sponsor reserves the right remove or to deny entry to winner and/or guests if any engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the race. Released Parties are not responsible for postponement or cancellation of the Race. If, for any reason, Race is postponed or cancelled, trip will be awarded without Race tickets on same itinerary and no compensation or substitution will be provided for difference in prize value. ARV: $4,000. Total ARV of all prizes: $10,300. Actual value of either prize may vary based on point of departure and dates of travel. All costs and expenses associated with the acceptance and use of a prize not included in the prize description as being awarded (including, but not limited to, federal, state and local taxes, fees, gratuities, meals, tips and insurance) will be the responsibility of the winners. Each winner and his/her guest must travel together on same itinerary and are responsible for obtaining all necessary travel documents. A guest must be of legal age of majority in his/her state of residence (and at least 18) unless accompanied by his/her parent/legal guardian. A guest (or, if a minor, his/her parent or legal guardian) must execute and return a liability/publicity release prior to prize award. All travel arrangements must be made through Sponsor’s agent on a carrier of Sponsor’s choice. Exact travel dates and arrangements are subject to availability, blackout dates and other restrictions. Additional restrictions may apply. Grand and First Prize winners may elect to receive Accolades Award Points for the amount of the ARV in lieu of the prize. Accolades Award Points are subject to certain terms and conditions. Limit: one (1) prize per licensed distributor. Unless otherwise specified herein, no substitution, cash redemption or transfer of prizes permitted by winners. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Sponsor is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. All prize details are at Sponsor’s sole discretion.
4. ELIGIBILITY: Sweepstakes open to selected TopChoice licensed distributors, who are authorized to do business in the U.S., or if an individual, a legal resident of the United States (excluding Puerto Rico and U.S. territories and possessions), and who are 21 or older as of 3/1/06, except employees (and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Sponsor, Marketing Drive PSG, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies. Entrants’ eligibility is subject to policies of entrants’ employers concerning the acceptance of incentive benefits, and by entering the sweepstakes each individual entrant warrants that s/he is eligible to participate under his/her employer’s policies. Void in Puerto Rico and U.S. territories and possessions and where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.
5. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Potential winners will be required to execute an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be forfeited and, at Sponsor’s discretion, awarded to alternate winner if affidavit/release(s) is/are not returned within 14 days after date of mailing to winner, noncompliance with these Official Rules or if prize notification or prize is returned as undeliverable or if 2 attempts to contact winner by phone are unsuccessful. If winner is not an individual licensed distributor but an employee of a company, prize will be awarded in the name of the company who will be responsible for deciding which employee shall make use of the prize. By acceptance of prize, each winner agrees to the use by Sponsor and its designees of his/her name, business name, address (city and state of residence), likeness, and/or prize information for advertising and promotional purposes in any and all medium now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law.
6. GENERAL: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects; and (b) to release, discharge and hold harmless Sponsor, Marketing Drive PSG, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or the acceptance, possession, use or misuse of the awarded prize (including any travel or activity related thereto). Sweepstakes will be governed by the internal laws of the State of North Carolina. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States of America. Released Parties are not responsible for late, lost, stolen, damaged, incomplete, inaccurate, misaddressed, misdirected or postage-due entries or mail; or for other errors or problems of any kind whether typographical, printing, human, mechanical, electronic or otherwise relating to or in connection with this Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Sponsor may disqualify anyone from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. Sponsor reserves the right in its sole discretion to cancel, modify or suspend the Sweepstakes should causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes and if terminated, at Sponsor’s discretion, award the prizes from among all eligible, non-suspect entries received up to time of such impairment.
7. WINNERS LIST: For a list of winners (available after 7/31/06), send a hand-printed, self-addressed stamped envelope by 6/14/06 to: TopChoice Incentive Sweepstakes Winners List Request, PO Box 282, Wilton, CT 06897-0282. Winners list will be provided after selection and verification of winners.
